This extensive paper, which will be published in several parts, is an edited version of a longer document which formed the basis of a presentation made on August 24, 2012, by Dr Ralph E. Gonsalves, Prime Minister of St Vincent and the Grenadines, at the closing session of “the Fifty-Fifty” Conference of the Sir Arthur Lewis Institute of Social and Economic Studies (SALISES) of the University of the West Indies in Kingston, Jamaica. Among other things, the publication excludes the section on “the Grenada Revolution” (1979 – 1983) which is amply covered in the prime minister’s autobiography entitled The Making of ‘the Comrade’: The Political Journey of Ralph Gonsalves.
This paper contains, too, the essence of Dr Gonsalves’ discussion on the subject “Rethinking Policy to Address Low Growth and High Debt: The Economic Challenges Facing the OECS/Caribbean” on September 04, 2012, at a recently-concluded “High Level Forum” sponsored by the International Monetary Fund, the Caribbean Development Bank, and the Central Banks of CARICOM member-countries at Port-of-Spain, Trinidad and Tobago.
The ideas of Dr Gonsalves, contained in this paper, are well-known to those who have followed his speeches and writings, especially his Budget Addresses, his United Nations Speeches, his Addresses to CARICOM and OCS, national and international gatherings, and his various publications over the past dozen or so years. They constitute what he calls “a compelling narrative” for socio-economic development. He weaves history, philosophy, literature, economics, law, politics, sociology, policy-making, public administration, governance, and more, into his integrated narrative.
Part 5: The Revised Treaty of Basseterre 2010 – 2011
The 2010 Revised Treaty of Basseterre, inclusive of its Dispute Settlement Annex and the Economic Union Protocol, has revamped the original Treaty in at least seven major ways, namely: The strengthening of the framework for functional cooperation; the creation of a single financial and economic space; the securing of the freedom of movement of citizens of the protocol member-states (the independent countries of the OECS and Montserrat; Anguilla and the British Virgin Islands are “associate members”); the establishment of areas of exclusive legislative competence and restrictive legislative competence; the according of additional decision-making powers to the OECS Authority, the Council of Ministers, and the Economic Affairs Council; the fortifying and extending of the general administrative oversight within the OECS through the creation of the OECS Commission, presided over by the OECS Director-General with representation, at ambassadorial rank, from each member-state; and the introduction of a “legislative filter” through the establishment of the OECS Assembly. All these innovations are directed at deepening and broadening OECS integration, improving responsible and more effective governance of the OECS, and delivering more benefits much better to the people of the OECS.

Each member-state, which has signed and ratified the Revised Treaty, has solemnly agreed to take all steps to secure the enactment of laws which are necessary to give effect to the provisions of this Treaty and decisions taken thereunder. Specific obligations are imposed on each member-state within the framework of the general undertaking as to implementation. At the same time, the Revised Treaty declares, in Article 5.4 thereof, that:
“Nothing in this Treaty requires a Member-State to undertake amendments to its Constitution, and its obligations as to implementation are circumscribed accordingly.”
(i) OECS Assembly
This OECS Assembly derives its structure and authority from the Revised Treaty which has been put into the domestic law, statutorily, by the respective Parliaments of each member-state.
Each member-state sends five of its legislators to this Assembly, chosen by the legislative body of each member-state, from government and opposition parliamentarians proportionately, to represent their constituents. The central role of the OECS Assembly, as set out in Article 10.13 of the Revised Treaty, is to consider and report upon: (a) to the OECS Authority on any proposal to enact an Act of the OECS and on any other matter referred to the Assembly by the Authority; and (b) to the Council of Ministers in the case of any proposal to make certain regulations which have been referred to the Authority.
(ii) Legislative Competencies
The matters of relevance which the OECS Assembly may be called upon for consideration and reportage include specifically the five areas of legislative competence of the OECS Authority, namely: the Common Market including the customs union; monetary policy; trade policy; maritime jurisdiction and maritime boundaries; and civil aviation; three areas of restrictive legislative competence, namely, common commercial policy, environmental policy, and immigration policy; and other areas of sub-regional coordination necessary for a better achievement of the purposes of public policy.
In the latter regard the whole range of matters in the Economic Union Protocol are likely to be considered and reported upon by the OECS Assembly including: trade issues and the free circulation of goods in the economic union; freedom of movement of citizens of the protocol member-states within the economic union area; economic transformation; economic growth, employment, and poverty reduction; policies for the various economic sectors and sub-sectors; fiscal policy; incomes policy; law and order and citizen security; health and education; social security; sports and culture; air and sea transportation; airports and seaports; CARICOM affairs; foreign policy; and international economic relations.
It is to be noted that in relation to two specific areas of legislative competence for the OECS Authority, that is to say, monetary policy and civil aviation, the competencies are circumscribed as per Article 14.1 of the Revised Treaty. Thus, in the area of monetary policy, the competence in this category is to be exercised by the OECS Authority only on the recommendation of the Monetary Council of the Eastern Caribbean Currency Union (ECCU). Similarly, in civil aviation, the competence in this category is to be exercised only on the recommendation of the Board of Directors of the Eastern Caribbean Civil Aviation Authority (ECCAA). Article 6 of the Revised Treaty lists the Eastern Caribbean Central Bank, the ECCAA, and the Eastern Caribbean Supreme Court as institutions of the OECS but it is made absolutely clear that this listing “does not impair any powers or jurisdiction of any of these institutions.”
(iii) Loving and Caring for the OECS
On the occasion of the formal opening of the 55th Meeting of the OECS Authority on June 10, 2012, when I assumed the one-year rotating office as Chairman of the Authority, I highlighted five broad areas of priority on which we ought to work assiduously over the next ten months or so. I reiterate them here.
First, we all must love and care for the OECS. This sounds simple; the cynical may consider it trite or wolly. Far from it; it is the most important consideration or goal. Each of us has an obligation to love and care for his or her family and to be considerate to those who depend on us. The OECS is part of our extended family; indeed, politically, it is our family. If we speak in all the highfalutin tongues of men and women, or even of angels, but we have not love or caring, we are merely sounding brass and clanging cymbals. Our love and caring for the OECS must protect and preserve it, and contain our hopes and faith for the future. In everything we do or say politically, we must have the OECS at its centre. We must approach its work with steadfastness and creativity; it must bind us ever more together. And our governments must make every effort to pay the dues required for the OECS and its organs to survive and thrive.
Secondly, over the next year, we must continue the process of consolidating and extending our gains from the OECS and its institutions or mechanisms which deliver value to our people. These gains flow especially from our coordinated and integrated work in the free movement of our people, money and banking, the judiciary, civil aviation, education and health, telecommunications, the environment, maritime matters, external trade and foreign policy, national security, poverty reduction, capacity building, and other vital areas of functional cooperation.
Thirdly, we must make the Revised Treaty of Basseterre Establishing the Economic Union take root. This recent advance in our sub-regional governance deepens and improves the integration mechanisms. The new institutions such as the consultative OECS Assembly, the Economic Affairs Council, and the OECS Commission must be placed on a solid footing. Vitally, all matters resident in the Annex and Economic Union Protocol are to be fully elaborated, and put within appropriate juridical frameworks over the next year. This Protocol is of great importance, for example, to the freedom of movement of persons and goods. A host of trade issues are to be fine-tuned. The work ahead is hefty. The agenda is heavy-laden and the hands are few.
Fourthly, we must finalise all necessary arrangements for the Revised Treaty of Basseterre to be accorded a special and differential place in the Revised Treaty of Chaguaramas which establishes CARICOM. Some within the wider CARICOM are resisting this reasonable proposal so necessary and desirable for the continued optimal functioning of CARICOM. I feel sure, however, that wisdom will prevail in this regard.
Fifthly, the OECS has to navigate itself properly, in its own interest, through and within a series of other cross-cutting regional mechanisms including CARICOM, the Economic Partnership Agreement between CARIFORUM and the European Union, the proposed associate status of Martinique and Guadeloupe with the OECS, the ALBA (the Bolivarian Alternative for our America), the Community of States of Latin America and the Caribbean (CELAC), and trading or developmental arrangements with other countries such as the USA and Canada. The configuration of regional integration is being altered before our very eyes; so, the OECS, and CARICOM too, must accommodate themselves, in their own interest, to the altered and altering regional and global landscape of a more integrated political economy. Accommodation, yes, but we must also resist creatively and sensibly where such resistance is necessary and desirable.
Do not for one moment think that we cannot suffer reversals in our sub-regional integration movement. To be sure, we have made immense progress since the original Treaty of Basseterre was signed in 1981. Our Revised Treaty of Basseterre of 2010 has made a quantum leap in regional governance and the creation of a single economic space. But challenges abound. Ironically, the global economic crisis which ought to cause us to bind ourselves ever more closely in a more perfect union, contains ingredients to divide and fragment us. Remember, too, that our very “islandness” sometimes engenders unseemly nationalist or even chauvinistic impulses. So, let us ever be reminded that divisiveness and West Indian unity are riding partners. We do not have far to look: CARICOM has suffered severe setbacks recently and is currently on “pause” in its quest for a single economy. Let us avoid these kinds of reversals in the OECS. That is why I urge that above all we must love and care for the OECS. It is our anchor in the dangerous regional and global communities.

Caribbean governments urged to repeal criminal defamation laws. I believe this matter has become an international matter mainly because of the serial suing by GONSALVES of Vincentian citizens and companies.
Its time for GONSALVES to stop acting like a colonial master and stop suing people like he is the owner of a great sugar cane estate, a Plantation owner. Remember I always said that I considered GONSALVES is worth no more than a bag of manure when the courts make him awards.
Judges and courts should stop making judgments in his favor that give him huge awards, its indecent and disgusting, and shows how the legal system is a disgrace to its self.
The danger is that an old boys system is operating in the justice system that benefits GONSALVES.
All of GONSALVES old talk about colonialism, and here he is a leading colonialist, and a MARXIST one at that. If you look at the behavior of GONSALVES he shouldn’t even be afforded the title honorable, he is a disgrace to Vincentian society.

Caribbean governments urged to repeal criminal defamation laws
(IPI/IFEX) - VIENNA, Oct 15, 2012 – The International Press Institue (IPI) today released a final report on its June mission to four Caribbean countries, cautiously welcoming progress in three of them toward the repeal of criminal defamation and insult laws but urging political leaders to remain committed to reform.
During the nearly two-week long mission, IPI delegates met with representatives of government, law enforcement, media, and civil society in Barbados, the Dominican Republic, Jamaica, and Trinidad and Tobago as part of IPI's campaign to decriminalize defamation across the Caribbean.
In June 2012, the International Press Institute (IPI), in conjunction with its strategic
partner, the Association of Caribbean Media Workers (ACM), conducted a two-week
mission to Barbados, Jamaica, the Dominican Republic and Trinidad and Tobago as part
of its wider campaign to end criminal defamation in the Caribbean.
The ultimate aim of the campaign is to push for the abolition of criminal laws currently in
place in the Caribbean that concern defamation, slander, libel or insult. The campaign
encourages the use of civil laws to address such concerns, in line with international
press-freedom standards and the recommendations expressed by regional and
international human-rights bodies.
Currently, all 13 independent states in the Caribbean have criminal defamation laws on
their books that establish a penalty of at least one year in prison. Libel deemed seditious
or obscene remains a separate offence in a majority of Caribbean countries and
generally entails stiffer punishments, with prison sentences of up to five years in certain
cases.
Particularly in the English-speaking Caribbean, many of the laws in place are near-exact
replicas of colonial-era acts dating back to the mid-19th century. Lord Campbell’s Act
(also known as the Libel Act of 1843), which serves as the foundation for a number of
defamation statutes across the Caribbean, was itself largely repealed in England in 2009.
Bucking a global trend, the Caribbean has witnessed active criminal libel prosecution
over the past 15 years, with cases being brought recently in the Dominican Republic,
Grenada and Antigua and Barbuda.
The four countries visited by IPI in June were strategically selected on the basis of their
regional influence, demonstrated readiness for defamation reform or in response to
immediate concerns about the application of libel law. The mission to Trinidad and
Tobago coincided with IPI’s 2012 World Congress held in Port of Spain from 23 -26 June.
The mission was premised on a domino theory by which individual successes are used to
build momentum and place pressure on neighboring countries to follow those positive
examples.
In each country, IPI’s advocacy efforts targeted representatives of government and law
enforcement agencies, journalists and press freedom organizations, law and journalism
faculties as well as civil society groups.
This experience reflected IPI’s overall campaign strategy of building support in each
Caribbean country via direct contact with political and media stakeholders to lobby on
behalf of revisions or amendments to existing defamation laws, and through coordinated
media coverage of visits and the placement of opinion pieces in local media.

In 1992 Ralph Gonsalves in an address to the Barbados Bar Association noted that
" I find the approach of both parliament and the judiciary is less than wholesome in the protection of the constitutional right of freedom and expression. Too often Caribbean legislator's go beyond the outer limits of a persons rights to free freedom of expression and they are insufficiently reproached by Caribbean judges"
Was that just a MARXIST trying to have his voice and opinions heard without interruption by the governments and laws?
Now the man is in power all those values that he voiced have been abandoned or dumped. Its what's called MARXIST manipulation.
I consider that under GONSALVES we are under a dire threat of a dynasty being formed, a dictatorship, with his son waiting in the wings on the fathers promise of power being handed to him on his retirement.
If you look at all the Vincentian newspapers of the early GONSALVES era, he was hated by our parents and grandparents, they described him as a Marxist, a man without God, and a worshipper of Cuba and Russia. Perhaps the old folks were right and we should heed their warnings, which in most cases are now warnings from the grave.
